1. Acceptance of Terms

By accessing or using www.crafteca.mx (the “Platform”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please do not use the Platform.

We reserve the right to update or modify these Terms at any time. Continued use after any changes constitutes your acceptance of the new Terms.

2. Platform Overview

Crafteca is an online platform that connects users to buy and/or sell handmade, artisanal, or creative products and services.

We may act as an intermediary between buyers and sellers but are not the producer of the goods unless explicitly stated.

3. User Accounts

To use certain features of the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account

You are solely responsible for all activities that occur under your account.

4. Orders and Payments

  • Prices, shipping fees, and taxes are displayed prior to checkout.
  • All payments are processed securely via third-party payment providers.
  • Crafteca reserves the right to refuse or cancel any order at its sole discretion.

If a seller fails to fulfill an order, Crafteca may assist with refunds, but final responsibility lies with the seller.

5. Seller Responsibility

If you are a seller on the Platform, you agree to:

  • Accurately describe your products and pricing
  • Fulfill orders in a timely manner
  • Comply with applicable consumer protection and tax laws
  • Refrain from selling prohibited or illegal items

Crafteca reserves the right to remove listings or suspend accounts that violate these Terms.

6. Returns and Refunds

Return and refund policies may vary by seller. Buyers should review the individual store’s return policy before purchasing.

Crafteca may mediate disputes, but resolution is not guaranteed. You agree to work in good faith to resolve any issues.

7. Prohibited Conduct

You agree not to:

  • Use the Platform for illegal or unauthorized purposes
  • Post false, misleading, or infringing content
  • Harass, abuse, or harm others
  • Attempt to hack, scrape, or disrupt the Platform

Violation of these rules may result in suspension or termination of your account.

8. Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is the property of Crafteca or its licensors and is protected by intellectual property laws.

You may not reproduce, distribute, or create derivative works from any content without permission.

9. Privacy

Your use of the Platform is subject to our Privacy Policy which describes how we collect, use, and protect your personal data.

10. Disclaimer of Warranties

Crafteca provides the Platform “as is” and makes no guarantees regarding:

  • Product quality, accuracy, or availability
  • Seller or buyer conduct
  • Continuous or secure access to the Platform

Use of the Platform is at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law, Crafteca shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

12. Indemnification

You agree to indemnify and hold harmless Crafteca, its directors, employees, and partners from any claims, liabilities, damages, or expenses arising from your use of the Platform or violation of these Terms.

13. Governing Law

These Terms shall be governed by the laws of the United Mexican States. Any disputes shall be resolved in the courts located in Nuevo Vallarta, Mexico.
